These general terms and conditions apply to all orders and agreements concluded via Mingtea's webshop or directly with Mingtea. By placing an order, the customer accepts these general terms and conditions.

2. Applicability
These general terms and conditions apply to Mingtea's offers and to every agreement between Mingtea and a customer.
Any deviations from these terms and conditions apply only where they have been expressly agreed in advance between Mingtea and the customer.
If any provision of these general terms and conditions is wholly or partially invalid or unenforceable, the remaining provisions will remain in force.
3. Product information and offers
We do our best to describe and depict our products as fully and accurately as possible.
Tea and other natural products may, however, differ in colour, shape, size, scent or appearance. Photos on our webshop are therefore intended to provide an image that is as accurate as possible, but minor natural differences may occur.
An offer is valid while stocks last, unless stated otherwise.
If a product unexpectedly proves to be unavailable after an order has been placed, we will contact the customer as soon as possible. If no suitable alternative is agreed, the relevant amount will be refunded.
4. Prices
The prices on our webshop are shown in euros and include VAT where applicable, unless expressly stated otherwise.
Any shipping costs will be clearly displayed before the order is definitively placed.
Mingtea may change its prices and offers. A price change does not affect an order that has already been definitively concluded, except where there is an obvious error.
In the event of an obvious pricing, typographical or input error, Mingtea is not obliged to supply a product at an evidently incorrect price.
5. Conclusion of the order
An order is concluded when the customer definitively confirms the order via the webshop and Mingtea receives the order.
After placing an order, the customer receives an electronic confirmation at the email address provided.
Mingtea reserves the right to refuse an order or request additional information where there is a legitimate reason to do so, for example in the event of suspected fraud, an obvious error or an exceptionally large order.
6. Payment
Orders placed through the webshop are paid using the payment methods offered during checkout. Online payments are processed through our payment service provider.
For business customers, Mingtea may, following prior agreement, allow payment by bank transfer against an invoice. Unless otherwise agreed in writing, the payment period for such invoices is 14 calendar days from the invoice date.
For large, special or custom-agreed orders, Mingtea may request full or partial advance payment. In that case, the applicable payment terms shall be agreed with the customer before the order is placed.
In the event of late payment by a business customer, the legally applicable late-payment interest and collection costs may be charged.
7. Delivery
Mingtea will do its best to process and ship orders as quickly as possible.
The stated delivery times are indicative, unless expressly agreed otherwise. A delay by a carrier does not automatically entitle the customer to compensation.
The customer is responsible for correctly entering the delivery address and contact details.
If a parcel cannot be delivered due to incorrect or incomplete information provided by the customer and is returned to Mingtea, the costs of a new shipment may be charged to the customer.

8. Right of withdrawal for consumers
When you make a distance purchase as a consumer, you generally have the right to withdraw from the agreement within 14 calendar days without giving any reason.
The withdrawal period begins on the day after you, or a third party designated by you who is not the carrier, physically receives the goods.
To exercise the right of withdrawal, you must clearly inform Mingtea of your decision to withdraw from the agreement before the withdrawal period expires.

After notifying us of the withdrawal, you must return the products to Mingtea no later than within 14 days.
The consumer's right of withdrawal is without prejudice to any statutory exceptions that may apply in a specific situation.
9. Returns and refunds
The direct costs of returning a product after withdrawal shall be borne by the consumer, unless Mingtea has expressly indicated otherwise.
The customer is responsible for appropriate and adequately protective return packaging.
The consumer may inspect and assess a product to the extent that this would reasonably be possible in a physical shop. If a product has been used or handled beyond what is necessary to establish its nature, characteristics and functioning, the consumer may be liable for the resulting reduction in value.
In the event of a valid withdrawal, we will refund the payments received to which the withdrawal relates, including the standard costs of the original delivery insofar as this is required by law.
If the consumer has expressly chosen a more expensive delivery method than our cheapest standard delivery, we are not obliged to refund the additional costs of that more expensive delivery method.
The refund will be issued no later than within the legally prescribed period of 14 days after we have been informed of the decision to withdraw from the agreement.
We may wait to issue the refund until we have received the goods or until the consumer has demonstrated that the goods have been returned, whichever is earlier.
The refund will in principle be made using the same payment method as that used for the original order, unless otherwise agreed.
10. Incorrect, damaged or missing product
Check your order upon receipt.
If a product is delivered incorrectly, damaged or incomplete, please contact us as soon as possible via info@mingtea.be. Please state your order number and, if possible, attach photographs so that we can assess the problem quickly.
This notification procedure does not affect consumers' statutory rights.
11. Statutory warranty and conformity
For consumers, the statutory warranty for consumer goods applies in accordance with the applicable Belgian legislation.
For new consumer goods, the statutory warranty period is in principle two years from delivery.
A product must conform to what the consumer may reasonably expect based on the agreement, product description and applicable law.
If a product has a lack of conformity, the consumer may contact Mingtea via info@mingtea.be.
The consumer's statutory warranty rights may not be restricted by these general terms and conditions.
12. Complaints
If you have a complaint about a product, order or our services, please contact us via info@mingtea.be.
Please preferably state your order number and provide a clear description of the problem. Where relevant, you may add photographs.
We endeavour to resolve complaints as quickly as possible and in consultation with the customer.
13. Liability
Mingtea is responsible for the proper performance of its obligations in accordance with the agreement and applicable law.
Mingtea shall not be liable for damage resulting from incorrect or improper use of a product, failure to follow instructions for use or preparation, or circumstances that are reasonably beyond our control, insofar as such a limitation is permitted by law.
Nothing in these general terms and conditions limits or excludes liability where such limitation or exclusion is not permitted under applicable law.
14. Force majeure
Mingtea shall not be liable for delays or failures resulting from circumstances over which it can reasonably exercise no control, such as serious disruptions, natural disasters, strikes, government measures, war, epidemics, problems with carriers or other cases of force majeure.
If a force majeure situation makes it impossible to fulfil an order for an extended period, we will seek a suitable solution together with the customer.
15. Personal data
When processing orders and using our online shop, we process personal data.

16. Consumers and business customers
Provisions in these general terms and conditions that specifically arise from consumer protection legislation, such as the statutory right of withdrawal, shall apply to consumers insofar as provided by law.
For business customers, separate arrangements may be made regarding, among other things, prices, discounts, quantities, payment terms, advance payments and delivery. Where such arrangements have been agreed in writing, they shall take precedence over the corresponding provisions of these general terms and conditions.
17. Applicable law and disputes
Agreements with Mingtea are governed by Belgian law, insofar as this choice of law does not deprive a consumer of the protection afforded by mandatory provisions of the law that would apply in the absence of this choice of law.
We will first attempt to resolve any disputes in consultation with the customer.
If no amicable solution can be reached, consumers may use the available competent out-of-court dispute resolution bodies or refer the matter to the competent court.
For business customers, disputes shall, insofar as legally permitted and unless otherwise agreed in writing, be submitted to the competent Belgian court.
18. Amendments to these general terms and conditions
Mingtea may amend these general terms and conditions when necessary, for example due to changes to our services, online shop or applicable legislation.
As a rule, an order is subject to the general terms and conditions that applied when the order was placed.
